Can I seal my records?

The answer is yes, but not in the way most people think. Sealing your records doesn’t mean that you have a clean slate. Your criminal record is still on file, but it is no longer searchable. This is particularly important to you when applying for a job or a home loan. In the event of a background check, criminal record personnel would be required to say that there’s no record available. You won’t find this option for many criminal charges, specifically felonies, but in the case of misdemeanors, the option is there as long as you fit the criteria necessary to seal records. Follow these important steps:

  • Obtain a record of your criminal history and arrests. You can make a trip to the county courthouse and ask the county clerk for a copy after paying the fee.
  • Complete the petition. It’s important to include the case number and warrant number for the violation in question. You only need to fill out the top portion of the petition titled Denying Petition. Be sure not to sign any paperwork without the presence of a notary public.
  • File the papers with the court. It costs approximately $224 to file your paperwork. You need to sign the papers with the court clerk as a witness, unless you already had a notary public watch you do it.
  • Wait for the court to respond. If by chance your petition is denied for any reason, you can expect to receive a copy of that denial in the mail. If the court approves the petition, a hearing is set and a document is mailed to you with the details.
  • Send a copy of your petition approval to the Colorado Bureau of Investigation (CBI). It’s crucial to ensure that the CBI and all other agencies associated with the arrest receive your approval document. This includes the court and the police department. Once you’ve sent that approval, expect your records to be sealed within 30 days.
